Protecting the Family Jewels:
Keeping assets in the bloodlines and protecting assets from potential creditors -
How to do it without surrendering flexibility and control
This program has been accepted by CFP Board for 3 CFP CEUs
This three hour program will educate financial planners, CPA's and attorneys, and therefore allow them to educate their clients, on how to keep assets owned by family members from ending up in undesired hands.
It will address how to protect assets that parents wish to ultimately leave for the benefit of children and grandchildren from possible future distribution to in-laws in the event of a child's divorce. It will also address how to protect such assets from daughter-in-laws' and son-in-laws' spousal elective rights (if a child were to predecease a child's spouse), so that assets can ultimately be preserved not only for the benefit of children, but also for the benefit of grandchildren, without any dilution. Intergenerational Trusts, prenuptial agreements, family limited partnerships, and qualified plans, and the asset protection advantages available from the use of these techniques and vehicles, will be discussed.
A primary focus of the program will be to explain the substantial asset protection and tax benefits available from the use of Delaware Asset Protection Trusts. How the use of a Delaware trustee can simultaneously serve to protect assets from creditors and reduce or eliminate state income and state estate taxes, while still allowing for the Grantor to have access to the trust funds, will be discussed. An explanation of how all of this can be accomplished without the need to change any pre-existing financial or investment advisory relationships will be explained.
During dinner, you will have the opportunity to participate in a facilitated discussion to talk about why and under what circumstances would the use of one type of asset protection technique be preferable to another, and what are the relative advantages and disadvantages of each.
